Terms of Use for Eatix

These Terms of Use ("Terms") govern your access to and use of the Eatix mobile application, website pages, and related services (the "Service"). By using Eatix, you agree to these Terms. If you do not agree, do not use the Service.

Response Time: We will respond to support and legal inquiries within a reasonable time, and privacy inquiries within 30 days of receipt.

1. The Eatix Service

Eatix helps users log meals, analyze meal photos and descriptions, estimate calories and nutrients, manage nutrition goals, and maintain meal history.

The Service may include:

• Meal photo analysis.
• Text and voice meal descriptions.
• AI-generated meal and nutrition estimates.
• Meal history, favorites, custom foods, and daily nutrition summaries.
• Profile and goal settings.
• Subscription-based features.
• Support and feedback features.

Eatix may change, suspend, or discontinue parts of the Service at any time to improve the app, maintain security, comply with law, or manage operational needs.

2. Eligibility

Eatix is not intended for children under 16 (or under 13 in jurisdictions where that is the applicable age). By using the Service, you represent that you meet the applicable minimum age requirement and have the legal capacity to agree to these Terms.

If you use Eatix on behalf of another person, you are responsible for making sure you have the right to provide their information and use the Service for that purpose.

3. Account and App Session

Eatix may use Firebase Authentication, including anonymous authentication, to create and maintain an app session and secure requests to the Eatix backend.

You are responsible for:

• Maintaining control over your device and app installation.
• Keeping your device secure.
• Not allowing unauthorized use of your app session.
• Providing accurate information where the app asks for profile or nutrition details.

Some features may not work correctly if you delete local app data, uninstall the app, block required permissions, or restrict required network access.

4. Health, Nutrition, and Medical Disclaimer

Eatix provides nutrition information, calorie estimates, food estimates, and related suggestions for informational and convenience purposes only.

Eatix does not provide medical advice, diagnosis, treatment, disease prevention, or professional dietary advice. Eatix is not a medical device and is not a substitute for advice from a physician, registered dietitian, or other qualified healthcare professional.

You are solely responsible for decisions about your diet, nutrition, health, allergies, medical conditions, medications, and lifestyle. Always consult a qualified healthcare professional before making health-related decisions, especially if you have allergies, a medical condition, are pregnant, are breastfeeding, are following a prescribed diet, or have specific dietary requirements.

5. AI and Nutrition Estimate Disclaimer

Eatix may use automated systems and AI services, including OpenAI, to analyze photos, text, voice descriptions, and related context.

AI-generated and automated results may be inaccurate, incomplete, delayed, or inappropriate for your circumstances. Food identification, portion size, calorie values, macro values, ingredients, allergens, and health-related suggestions may be wrong.

You must review and verify results before relying on them. You should not rely on Eatix as the sole source of truth for allergies, medical restrictions, nutritional requirements, or safety-critical decisions.

6. User Content

"User Content" means photos, audio recordings, text, meal entries, profile information, feedback, support messages, and other information you submit, upload, create, or provide through the Service.

You retain any rights you have in your User Content. You grant Eatix a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, reproduce, process, analyze, display, and use User Content as necessary to provide, maintain, secure, support, and improve the Service, and as described in our Privacy Policy.

You represent that:

• You have the rights needed to provide User Content to the Service.
• Your User Content does not violate law or the rights of others.
• Your User Content does not contain harmful, unlawful, abusive, or misleading material.

Do not upload photos, audio, or messages that include sensitive information about other people unless you have the right to do so.

7. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, fraudulent, abusive, or deceptive purposes.
• Interfere with, disrupt, reverse engineer, overload, or attempt to gain unauthorized access to the Service.
• Circumvent usage limits, subscription controls, authentication, security, or payment systems.
• Upload malicious code or content that infringes, violates privacy, or harms others.
• Use automated scraping, data extraction, or bot activity without permission.
• Misrepresent AI-generated or estimated results as professional medical advice.
• Use the Service to develop, train, or benchmark competing systems unless expressly permitted by Eatix in writing.

We may suspend or restrict access to the Service if we reasonably believe you violated these Terms, created risk, or used the Service in a way that may harm Eatix, other users, service providers, or third parties.

8. Subscriptions, Purchases, and Payments

Eatix may offer paid subscriptions or premium features. Purchases may be processed through the Apple App Store, Google Play, or other authorized payment providers.

When you purchase through Apple or Google:

• Payment is handled by the applicable app store, not directly by Eatix.
• Renewal, cancellation, refunds, and billing issues are governed by the applicable app store terms and policies.
• You must cancel subscriptions through your Apple App Store or Google Play account settings.
• Deleting the app, clearing app data, or requesting deletion of app data does not automatically cancel a subscription.

Subscription availability, pricing, trials, features, and renewal terms may vary by country, platform, offer, and time.

9. Third-Party Services

Eatix relies on third-party services to operate, analyze, secure, and improve the Service. These may include OpenAI, Firebase and Google services, Google Analytics, Amplitude, AppsFlyer, Adapty, Apple App Store, Google Play, and other infrastructure or service providers.

Third-party services may be subject to their own terms, privacy policies, data processing terms, availability, limitations, and outages. Eatix is not responsible for third-party services except to the extent required by applicable law.

10. Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you acknowledge that information will be handled as described in the Privacy Policy available at:

11. Intellectual Property

Eatix, including the app, design, software, logos, text, graphics, interfaces, and other content, is owned by Eatix or its licensors and is protected by intellectual property and other laws.

These Terms do not grant you ownership of Eatix or any intellectual property rights in the Service. You may use the Service only as permitted by these Terms.

12. Feedback

If you provide ideas, feedback, suggestions, or other comments about Eatix, you grant us the right to use them without restriction or compensation, to the extent permitted by applicable law. This does not affect your privacy rights in personal information included in support or feedback communications.

13. Availability and Changes

We aim to keep Eatix available and useful, but we do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.

We may update the Service, modify features, introduce or remove functionality, change usage limits, or stop supporting certain platforms or versions. Some changes may require you to update the app.

14. Disclaimers

To the extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.

We disclaim warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, non-infringement, and suitability for health, nutrition, diet, or medical decisions.

We do not guarantee that:

• Food, calorie, nutrient, ingredient, allergen, or portion estimates will be accurate.
• AI-generated responses will be correct or complete.
• The Service will meet your health, diet, or fitness goals.
• The Service will be available without interruption or errors.
• Any particular feature will remain available.

15. Limitation of Liability

To the extent permitted by applicable law, Eatix will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, health outcomes, or other intangible losses arising from or related to your use of the Service.

To the extent permitted by applicable law, Eatix's total liability for any claim arising from or related to the Service or these Terms will not exceed the greater of: (a) the amount you paid to Eatix for the Service during the 12 months before the event giving rise to the claim; or (b) USD 50.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

16. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Eatix from claims, damages, losses, liabilities, costs, and expenses arising from or related to:

• Your use or misuse of the Service.
• Your User Content.
• Your violation of these Terms.
• Your violation of law or third-party rights.
• Health, nutrition, diet, or safety decisions you make based on the Service.

17. Termination

You may stop using the Service at any time. You may also delete local app data through app controls where available, device settings, or by uninstalling the app.

We may suspend, restrict, or terminate access to the Service if we reasonably believe you violated these Terms, created risk, or used the Service in a way that may harm Eatix, other users, service providers, or third parties.

Termination does not automatically cancel subscriptions purchased through Apple App Store or Google Play. You must cancel those subscriptions through the applicable app store.

18. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date and make the updated Terms available at https://eatix.life/terms.

If changes are material, we may provide additional notice in the app or by other reasonable means. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
